The Field of Being Terms and
Conditions
Effective date 9/17/2026
These Terms and Conditions govern the website, courses, recordings, workshops, events,
memberships, communities, downloads, and related educational offerings provided under The Field of
Being name. By visiting the website, creating an account, making a purchase, or using a Service, you
agree to these Terms and the policies linked at checkout.
1 Agreement to These Terms
The Field of Being is operated by Kristen Bomas, a Florida Corp, doing
business as The Field of Being (TFOB, we, us, or our). These Terms apply to https://thefieldofbeing.com/ and to
any website, checkout page, course portal, community, or account area operated for TFOB.
If you do not agree to these Terms, do not use the website or Services. When a sales page, order form,
enrollment agreement, event agreement, or other written contract gives terms for a specific Service, the
specific terms control if they conflict with these general Terms.
Our Privacy Policy, Consumer Health Data Privacy Policy, Community Guidelines, Recording Notice,
and any offer-specific terms presented to you form part of your agreement with TFOB when they apply
to your use or purchase.
2 Eligibility
You must be at least 18 years old and must have reached the age of majority where you live to create
an account, make a purchase, or use the Services. By doing so, you confirm that you meet this
requirement and may legally accept these Terms.
TFOB does not knowingly provide member Services to children. If we learn that an account holder does
not meet the age requirement, we may close the account and handle the related information under our
Privacy Policy and applicable law.
3 Educational Purpose and No Therapist Client Relationship
TFOB provides education, personal-development tools, group learning, and community experiences.
The Services are not psychotherapy, counseling, diagnosis, medical treatment, crisis care, or a
substitute for care from a qualified professional treating you directly.
Kristen Bomas holds professional credentials, but your use or purchase of a TFOB Service does not
create a therapist-client relationship with Kristen Bomas or Kristen Bomas, PA. A therapist-client
relationship may arise only through a separate written clinical agreement. Any private psychotherapy
services are governed by separate clinical, privacy, payment, and informed-consent documents.
The Services do not provide medical, legal, tax, financial, or investment advice. General comments,
answers, or feedback from Kristen Bomas, a TFOB team member, a guest, or another participant
remain educational and should not be treated as individualized professional care or advice.
Emergency Help
If you believe you may harm yourself or another person, or you are facing a medical or mental-health
emergency, call 911 or your local emergency number. In the United States, you may call or text 988 for
The Field of Being Terms and Conditions Draft | Page 3
the Suicide and Crisis Lifeline. Do not rely on a TFOB website, course, community, event, email, or
message for emergency help.
4 Voluntary Participation and Personal Responsibility
You decide what to share, which activities to try, and how to use the ideas presented through the
Services. You remain responsible for your choices, conduct, relationships, health care, finances, safety,
and personal circumstances. You may decline an exercise or stop participating at any time, subject to
the payment and refund terms that apply to your purchase.
Participation may bring up strong thoughts, memories, or feelings. You agree to seek qualified support
when needed and to use your own judgment before acting on educational content or group feedback.
5 No Promise of Results
Personal and relationship growth depends on participation, timing, circumstances, choices, and many
other factors. TFOB does not promise any emotional, relationship, health, business, financial, or other
result. Testimonials, examples, stories, and case material describe individual experiences and do not
guarantee that you will receive the same result.
6 Accounts and Individual Access
You agree to provide accurate and current account information and to keep your login credentials
private. Each purchase and account is licensed to one named individual unless the written offer states
otherwise.
You may not share, sell, transfer, lend, sublicense, or disclose your account, password, paid access, or
member-only materials. You are responsible for activity conducted through your account. Contact TFOB
promptly at [SUPPORT EMAIL] if you believe someone has used your account without permission.
We may apply reasonable device, session, or usage limits to protect the Services and enforce individual
licensing. We may suspend or close an account for credential sharing, fraud, unlawful activity, harmful
conduct, or a material breach of these Terms.
7 Offer Terms and Access Periods
Each sales page or checkout page will state the price, included materials, live features, access period,
delivery method, and payment schedule for that offer. Access begins on the date stated in the offer. If
the offer does not state a start date, access begins when the purchase is completed.
Communication Course
The current Communication Course is an individual program with six months of access beginning on the
purchase date. The purchase includes the recorded course for on-demand viewing during the access
period, a live virtual question-and-answer session offered every other week while live access remains
active, access to the private course community while community access remains active, and a
homework booklet made available upon payment.
The schedule, host availability, platform, and included features may be adjusted when reasonably
needed. TFOB will not materially reduce the purchased core offering without providing a reasonable
substitute or another remedy required by law or the offer-specific terms.
Technology Requirements
The Field of Being Terms and Conditions Draft | Page 4
You are responsible for a compatible device, internet service, current software, and any personal
technology needed to use the Services. TFOB is not responsible for access problems caused by your
device, connection, settings, or a service outside TFOB control.
8 Prices Payments and Payment Plans
Prices and payment terms appear on the applicable sales or checkout page. You authorize TFOB and
its payment processor to charge the payment method you provide for the full price or for each payment-
plan installment when due.
A payment plan divides one purchase price into installments. It is not a month-to-month membership
unless the checkout page expressly identifies it as a recurring membership. You remain responsible for
all installments, subject to rights that applicable law does not allow you to waive. Added access time
does not pause, cancel, or reduce a payment plan.
You agree to keep billing information current. TFOB may suspend access while a payment is overdue
and may restore access after payment. You are responsible for taxes that apply to your purchase.
If you believe a charge is wrong, contact [BILLING EMAIL] so TFOB may review it. Nothing in these
Terms removes a right you may have under payment-card rules or applicable law.
9 No Refund Policy Cancellations and Added Access Time
All Sales Are Final
Except when required by law or expressly stated in the written offer, all purchases are final and TFOB
does not provide refunds. This policy applies even if you change your mind, do not participate, do not
complete the Service, miss a live session, have a scheduling conflict, or are dissatisfied with your
progress or results.
TFOB may choose to provide a refund, credit, or other accommodation in a particular case. A voluntary
exception does not change this policy, create a right to the same treatment in another case, or require
TFOB to make another exception.
One Month Added Access Period
A purchaser who needs more time may request one extension of the purchased access period for one
additional month. The request must be made in writing to [SUPPORT EMAIL] before the original access
period ends. TFOB will confirm the added start and end dates in writing. Only one one-month extension
is available for each purchase unless TFOB chooses to grant another accommodation in a particular
case.
During the added month, the purchaser may continue using the access features included with the
purchase that remain available during that month. For the Communication Course, this includes
recorded course access, the private course community, and any regularly scheduled live question-and-
answer session that takes place during the added month. The extension does not create a right to a
make-up session, private session, or replacement for a live benefit missed during the original access
period.
Added access time is not a refund, account credit, transfer to another program, or right to join a future
offering. It belongs only to the original purchaser and does not change any remaining payment
obligations.
Memberships and Recurring Charges
The Field of Being Terms and Conditions Draft | Page 5
If TFOB offers a recurring membership, the sales and checkout pages will state the price, billing
frequency, renewal terms, initial term, cancellation method, and when access ends. By enrolling, you
authorize recurring charges until you cancel as stated in the offer.
You may cancel future renewals through [ACCOUNT CANCELLATION METHOD] or by written notice to
[SUPPORT EMAIL]. Cancellation stops charges scheduled after the current paid period. Access
continues through the end of that period unless TFOB terminates access for a material breach. TFOB
does not provide a prorated refund for a partly used billing period unless the offer or applicable law
requires one.
In Person Events and Retreats
In-person events and retreats may require advance commitments for venues, lodging, food, travel, staff,
and vendors. Deposits, cancellation rights, substitutions, travel responsibility, health and safety terms,
releases, and events outside TFOB control will be stated in a separate event or retreat agreement. That
agreement controls for the event.
Cancellation or Rescheduling by TFOB
TFOB may reschedule, replace, or cancel a live Service because of illness, safety needs, low
enrollment, platform failure, events outside its reasonable control, or another legitimate operating need.
If TFOB cancels a paid live Service and does not provide a replacement date or reasonably comparable
option, TFOB will refund the amount paid for that canceled Service. TFOB is not responsible for travel,
lodging, lost wages, or incidental costs unless a separate written agreement states otherwise.
Nothing in this section limits a right that applicable law does not permit you to waive.
10 Live Services Recordings and Transcripts
TFOB may record or transcribe a webinar, workshop, course session, question-and-answer session, or
other live Service. TFOB will provide notice when a session will be recorded or transcribed. The
registration page, entry screen, session notice, or separate Recording Notice may state what will be
captured, who may receive it, and how long it will be available.
By joining after receiving the notice, you consent to the stated capture and use of your name, display
name, voice, image, chat messages, and contributions as needed to provide the Service and recording
to eligible participants. If you do not consent, do not join the recorded session. When available, you may
keep your camera off, use a privacy-conscious display name, or use a private question method.
TFOB will seek separate permission before using an identifiable participant contribution in public
advertising or unrelated promotional material when required by law or the circumstances. Participants
may not record, transcribe, screenshot, copy, or distribute a live session or another participant
contribution without written permission.
11 Community Participation
TFOB may offer private groups, chats, discussions, live questions, comments, or related community
areas. You agree to communicate respectfully and may not post or send material that is unlawful,
threatening, harassing, discriminatory, defamatory, sexually exploitative, invasive of privacy, fraudulent,
infringing, malicious, or materially disruptive.
You may not post another person’s confidential information or content without permission. You may not
solicit members, advertise unrelated services, collect member information, send unwanted promotional
messages, impersonate another person, or interfere with community operation.
The Field of Being Terms and Conditions Draft | Page 6
TFOB may remove content, limit features, or suspend community access when it reasonably believes
content or conduct violates these Terms, threatens safety or privacy, or harms the community. TFOB
does not promise to review every post or message.
12 Community Privacy and Confidentiality
A private TFOB community is limited to its approved members and hosts, but it is a group setting. Other
members may see your display name, profile information, posts, comments, questions, and shared
material based on the platform settings. TFOB cannot verify every member identity and cannot promise
anonymity or confidentiality.
TFOB encourages members to use a privacy-conscious display name and to avoid posting details that
identify themselves or another person. Members must not repeat, record, screenshot, copy, or distribute
another member’s personal story or identifying information without permission. TFOB cannot promise
that every member will follow this rule. Share only what you are comfortable sharing in a group setting.
TFOB community discussions, educational questions, and group feedback are not private
psychotherapy sessions. Do not assume that the Florida psychotherapist-patient privilege or another
clinical privilege applies to those communications. Confidential clinical communications may receive
legal protection only when they arise within a qualifying therapist-client relationship governed by
separate clinical documents and applicable law.
TFOB educational systems and community areas should not be used to send clinical records, urgent
mental-health information, or emergency requests. HIPAA applies only when the legal requirements for
a covered entity or business associate are met. TFOB does not promise that every educational or
community communication is protected by HIPAA.
13 Blog Comments
Blog comments may be public, visible outside the TFOB community, and indexed by search engines.
Use a privacy-conscious display name if you do not want your legal name connected to a comment. Do
not include private health information, sensitive personal details, or another person’s identifying
information.
TFOB may review, edit, decline, close, or delete comments. Publication does not mean that TFOB
agrees with or endorses a commenter. A commenter remains responsible for the content submitted.
Blog comments and replies do not create a therapist-client relationship or individualized professional
advice.
14 Content You Submit
You retain ownership of original content you submit. You grant TFOB a limited, worldwide, royalty-free
license to host, store, reproduce, display, and moderate that content only as needed to operate and
provide the website, community, or Service. This license ends when the content is deleted, subject to
backups, legal retention duties, and copies already shared by other members.
You confirm that you have the rights and permissions needed to submit the content and that its use as
stated here will not violate another person’s rights. Do not submit content that you do not have
permission to share.
15 TFOB Intellectual Property and Limited License
The website and Services, including course methods, The Sage’s Template™, the BRIDGE Method™,
text, videos, audio, graphics, worksheets, presentations, exercises, downloads, names, logos, designs,
The Field of Being Terms and Conditions Draft | Page 7
and software, are owned by or licensed to [LEGAL ENTITY NAME] and are protected by copyright,
trademark, and related laws.
TFOB grants you a limited, personal, revocable, nonexclusive, nontransferable license to view and use
the materials provided to you for your own personal use during the stated access period.
Without prior written permission, you may not:
copy, reproduce, publish, upload, distribute, sell, license, or publicly display TFOB materials;
record live sessions or capture paid materials, apart from personal written notes;
share downloads, recordings, login credentials, or member-only content;
teach, train, coach, certify, or create a product or service using TFOB materials or proprietary
methods;
remove copyright, trademark, or ownership notices;
scrape, data-mine, reverse engineer, or use automated means to extract content; or
use TFOB content or member content to train, fine-tune, test, or build an artificial-intelligence
system, dataset, or competing offering.
Any permission must be in writing and may include added conditions.
16 Privacy and Consumer Health Data
The TFOB Privacy Policy explains what personal information TFOB collects, where it comes from, why it
is used, which service providers receive it, how long it is kept, and what choices may be available. The
Consumer Health Data Privacy Policy gives added information and rights for consumer health data
when applicable.
Consumer health data may include information that identifies or may be linked to a person’s physical or
mental health status. TFOB may extend access, deletion, withdrawal, recipient-list, and appeal rights to
users beyond the locations where those rights are legally required, as stated in the published Consumer
Health Data Privacy Policy.
TFOB will not sell consumer health data or use it for a purpose that requires separate consent or
authorization unless TFOB first obtains the legally required consent or authorization. Privacy requests
must be submitted through the secure method named in the applicable privacy policy.
17 Service Providers and Third Party Platforms
TFOB may use outside providers for website hosting, payments, email, course delivery, community
features, videoconferencing, scheduling, forms, analytics, advertising, file storage, customer support,
and other operations. These providers may process information for TFOB or under their own terms, as
described in the TFOB Privacy Policy and the provider’s policy.
The website or Services may link to outside sites, products, or resources for convenience. A link does
not mean that TFOB controls or endorses the provider. You use outside sites and resources under their
own terms and at your own risk.
18 Acceptable Website Use
You may not use the website or Services for unlawful, fraudulent, abusive, or harmful activity. You may
not upload malware, interfere with security or access controls, burden servers or networks, impersonate
another person, misstate an affiliation, gain unauthorized access, or use bots or scripts in a manner that
harms the website, Services, or another user.
The Field of Being Terms and Conditions Draft | Page 8
19 Service Availability and Changes
TFOB may update, replace, limit, suspend, or discontinue a feature or Service when reasonably needed.
TFOB does not promise uninterrupted, secure, or error-free access and may perform maintenance or
rely on platforms outside its control.
For a paid Service, TFOB will not materially reduce the purchased core offering without providing a
reasonable substitute or the remedy required by applicable law or the specific sales terms.
20 Suspension and Termination
You may stop using the Services at any time. Stopping use does not create a refund or cancel unpaid
installments except as stated in Section 9 or required by law.
TFOB may suspend or terminate access if you materially breach these Terms, fail to pay an amount
due, misuse the Services, infringe another person’s rights, or threaten safety, privacy, or proper
operation. When reasonable, TFOB may provide notice and a chance to correct the issue. Serious,
repeated, fraudulent, unlawful, or unsafe conduct may result in immediate removal without a refund,
subject to applicable law.
Payment obligations, intellectual-property rights, authorized use of submitted content, disclaimers,
liability limits, dispute terms, and any provision that must continue by its nature survive termination.
21 Disclaimers
To the fullest extent permitted by law, the website, Services, and materials are provided as is and as
available. TFOB disclaims express and implied warranties, including warranties of merchantability,
fitness for a particular purpose, title, and noninfringement.
TFOB does not warrant that content is complete, current, or free from error; that access will be
uninterrupted; or that the website or its servers will be free from harmful components. Some jurisdictions
do not permit certain warranty exclusions, so part of this section may not apply to you.
22 Limitation of Liability
To the fullest extent permitted by law, TFOB and its owner, officers, employees, contractors, presenters,
and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential
damages, or for loss of profits, data, goodwill, business opportunity, or personal relationships, arising
from the website, Services, materials, or these Terms.
To the fullest extent permitted by law, the total liability of TFOB and the listed parties for all claims
related to a Service will not exceed the amount you paid to TFOB for that Service during the 12 months
before the event giving rise to the claim.
These limits do not apply where liability cannot lawfully be excluded or limited.
23 Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless TFOB and its
owner, officers, employees, contractors, presenters, and agents from third-party claims, losses,
liabilities, and reasonable legal costs arising from your unlawful conduct, your infringement of another
person’s rights, content you submit, or your material breach of these Terms. This section does not
require you to indemnify a party for that party’s own unlawful conduct or negligence when such an
obligation is prohibited by law.
The Field of Being Terms and Conditions Draft | Page 9
24 Dispute Resolution
Before filing a formal claim, you and TFOB agree to send written notice describing the dispute and
requested resolution and to allow 30 days for a good-faith effort to resolve it.
Mandatory Mediation
If the dispute is not resolved during the informal period, the parties will participate in nonbinding
mediation before starting arbitration or an ordinary court action, unless applicable law permits a party to
proceed without mediation. The mediation may occur by video or in Palm Beach County, Florida. The
parties will choose a mediator together and will share the mediator’s fee equally unless they agree
otherwise in writing.
Binding Individual Arbitration
[PENDING AAA CLAUSE REVIEW AND ATTORNEY APPROVAL DO NOT PUBLISH THIS SUBSECTION UNTIL
APPROVED]
If mediation does not resolve the dispute, the dispute will be resolved by individual binding arbitration
administered by the American Arbitration Association under its Consumer Arbitration Rules. The
arbitration may take place by video, telephone, document submission, or in Palm Beach County, Florida,
as permitted by those rules. The arbitrator may award any individual remedy available under applicable
law. A court with jurisdiction may enter judgment on the arbitration award.
Either party may bring an eligible individual claim in small-claims court. Either party may seek temporary
or injunctive relief from a court to protect intellectual property, confidential information, account security,
or personal safety. A court may also enforce or review an arbitration award as allowed by law.
If this arbitration subsection is adopted, you and TFOB waive trial by jury and agree to bring claims only
in an individual capacity, not as a plaintiff or class member in a class, collective, consolidated, or
representative action, to the fullest extent permitted by law.
Fees and Costs
Each party will pay its own attorneys’ fees and legal costs unless applicable law, a signed settlement, or
a valid decision by the arbitrator or court provides otherwise. The parties will share the mediator’s fee
equally unless they agree otherwise. AAA administrative fees and arbitrator compensation will be
allocated under the AAA Consumer Arbitration Rules.
Nothing in this section takes away a consumer protection or remedy that cannot be waived under the
law where the consumer lives.
25 Governing Law and Court Location
Florida law governs these Terms, without regard to conflict-of-law rules, except when another
jurisdiction’s nonwaivable consumer law applies. Subject to Section 24, any permitted court proceeding
must be brought in a state or federal court with jurisdiction in Palm Beach County, Florida, and each
party consents to that location.
26 International Users
The Services are operated from the United States. If you access them from another country, you are
responsible for following local law. Nothing in these Terms limits privacy, cancellation, warranty, or
consumer rights that local law does not allow you to waive. TFOB may limit access in a location where it
is not prepared to offer or support the Services lawfully.
The Field of Being Terms and Conditions Draft | Page 10
27 Copyright Complaints
If you believe content available through a TFOB-controlled service infringes your copyright, send written
notice to [COPYRIGHT CONTACT EMAIL AND MAILING ADDRESS]. The notice should identify the
copyrighted work, the material at issue and its location, your contact information, your good-faith belief
that the use is not authorized, a statement under penalty of perjury that the information is accurate and
that you may act for the owner, and your physical or electronic signature.
TFOB may remove or restrict material in response to a valid complaint. TFOB does not claim a statutory
copyright safe harbor merely by publishing this section. If TFOB registers a designated agent with the
United States Copyright Office, this section must be replaced with the registered agent’s exact
information and the approved notice and counter-notice process.
28 Changes to These Terms
TFOB may revise these Terms. The effective date at the top identifies the current version. For a material
change affecting an existing paid Service or recurring membership, TFOB will provide notice when
required and will apply the change prospectively unless the law permits otherwise. Your continued use
after the effective date of revised Terms means you accept them to the extent allowed by law.
29 General Provisions
These Terms, the applicable privacy policies, the sales page, and any specific written enrollment or
event agreement form the agreement between you and TFOB for the applicable Service.
If a provision is found unenforceable, it will be limited or removed only to the extent needed, and the
remaining provisions will stay in effect. A waiver must be in writing and applies only to the stated
instance. You may not assign your rights under these Terms without written consent. TFOB may assign
these Terms as part of a merger, reorganization, sale, or transfer of the TFOB business or assets.
Headings aid reading and do not alter meaning. Electronic acceptance and electronic records may be
used for these Terms and purchases. TFOB may retain records showing the version accepted, date,
time, account, and related transaction.
